1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your access to and use of the Marginal Capital Platform. By creating an account, you acknowledge that you have read, understood, and agree to be bound by these Terms.
The Terms form a binding contract between you and Marginal Capital and are governed by applicable Cameroonian business, consumer, and cyber law.
2. Eligibility
You must be at least 18 years old to use the Platform. Use by minors is strictly prohibited.
3. Account Registration and Security
You agree to provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
4. Investment Services
Marginal Capital provides investment plans where funds deposited by you are pooled and traded by professional traders on your behalf. These services are subject to market risk and may result in gain or loss.
a. Risk Disclosure
Investments carry inherent risk. Returns are not guaranteed except where specifically stated in insured plans.
b. Professional Traders
We engage qualified trading personnel whose strategies and activities are governed by internal compliance standards and relevant financial laws.
5. Deposits and Withdrawals
Deposits are accepted via Mobile Money and Orange Money and converted to USD for trading purposes; withdrawals are converted back to local currency using competitive rates at the time of disbursement.
You agree that payment providers may impose their own fees, which are outside our control.
6. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose.
- Upload malicious software or attempt unauthorized access to Platform infrastructure.
- Provide false or misleading information.
Violation may lead to account suspension or termination.
7. Intellectual Property
The Platform’s technology, content, design, and all intellectual property rights therein are our exclusive property. You are granted a limited, non‑exclusive license to use the Platform for personal investment purposes only.
8. Limitation of Liability
To the extent permitted by law, Marginal Capital shall not be liable for any indirect, incidental, special, or consequential loss arising from your use of the Platform, including but not limited to loss of profits, reputation, or data.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of Cameroon and OHADA business law frameworks. Disputes shall be resolved through arbitration or competent national courts.
10. Modifications
We may modify these Terms at any time. Continued use after posting of changes constitutes acceptance of such changes.
